This Acceptable Use Policy ("AUP") governs your use of the website Arcgarde.com (the "Site") and all services provided by Arc Garde LLC and its affiliates ("Arc Garde," "AG," "we," "us," or "our"). This AUP is incorporated into and forms part of our Terms of Service.
By using the Site or engaging our services, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of your access to the Site and our services.
1. Permitted Use
The Site and our services are intended for:
- Individuals and businesses seeking information about our consulting, web design, development, and digital marketing services
- Current clients accessing project-related resources, communications, or deliverables
- General informational and educational purposes related to our services and industry

- Access, tamper with, or use non-public areas of the Site, AG's systems, or AG's technical delivery systems
- Interfere with or disrupt the Site, servers, or networks connected to the Site
- Use any automated systems, bots, scrapers, spiders, crawlers, or other automated means to access, monitor, or copy the Site or its content without our prior written permission
2.3 Data and Content Misuse
- Collect, harvest, mine, or scrape any personal information or data from the Site
- Use the Site or our services to build a competitive product, service, or database
- Copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying structure of the Site or any AG tools, systems, or methodologies
- Frame, mirror, or otherwise incorporate any part of the Site into any other website, application, or service
2.4 Communication Misuse
- Send unsolicited commercial communications (spam) through or in connection with the Site
- Impersonate any person, business, or entity, or falsely state or misrepresent your identity or affiliation
- Post or transmit any content that is defamatory, obscene, abusive, threatening, harassing, or otherwise objectionable
- Use the Site to engage in phishing, social engineering, or any form of deceptive communication
- Transmit any content that contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
2.5 Interference and Abuse
- Overload, flood, or overwhelm the Site or any connected infrastructure
- Take any action that imposes an unreasonable or disproportionately large load on the Site's infrastructure
- Interfere with any other user's use and enjoyment of the Site
- Use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site
2.6 Advertising and Commercial Use
- Use the Site for any commercial purpose not expressly authorized by AG
- Post or transmit any unauthorized advertising, promotional materials, or solicitation
- Use the Site to advertise, promote, or sell products or services without our prior written consent
3. Client-Specific Obligations
If you are a client of Arc Garde, you additionally agree to:
- Provide accurate, complete, and current information and materials as required for your project
- Maintain the confidentiality of all AG proprietary materials, methodologies, and deliverables as outlined in your engagement letter and our Terms of Service
- Not share, distribute, resell, or sublicense AG deliverables, tools, systems, or methodologies to third parties without our express written consent
- Not share login credentials, access tokens, or API keys provided by AG with unauthorized individuals
- Respond to project communications and decision requests within the timeframes specified by AG
- Pay all fees as agreed in your engagement letter or service agreement
- Not use AG deliverables or materials for any purpose that violates applicable laws, regulations, or third-party rights
4. Content Standards
Any content you submit, post, or transmit through the Site (including form submissions, messages, and communications) must:
- Be accurate and not misleading
- Comply with all applicable laws and regulations
- Not infringe any intellectual property, privacy, or other rights of any third party
- Not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable
- Not promote discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group
- Not promote illegal or harmful activities
- Not contain any viruses, malware, or other harmful code
5. Enforcement
5.1 Monitoring
We reserve the right, but are not obligated, to monitor use of the Site and compliance with this AUP. We may investigate any suspected violation of this AUP and cooperate with law enforcement authorities in prosecuting users who violate the law.
5.2 Consequences of Violation
If we determine, in our sole discretion, that you have violated this AUP, we may take any action we deem appropriate, including:
- Issuing a warning
- Temporarily or permanently suspending or terminating your access to the Site and our services
- Removing any content that violates this AUP
- Reporting the violation to law enforcement authorities
- Taking legal action, including seeking injunctive relief and damages
5.3 No Refunds for Violations
If your access to the Site or our services is terminated due to a violation of this AUP or our Terms of Service, you are not entitled to any refund of fees paid.
